De wet verplicht scheepseigenaars en iedereen die verantwoordelijk is voor de exploitatie van het schip om een verzekering aan te gaan. De hier bedoelde verzekering is typisch de klassieke P&I-dekking, en dit voor vorderingen tot de bedragen voorzien in het LLMC-verdrag (zoals aangepast in het protocol van 1996). De verplichting, zoals opgelegd door de Belgische wet, geldt voor schepen onder Belgische vlag alsmede voor alle schepen die een Belgische haven aandoen, ongeacht onder welke vlag men vaart.

De vereiste certificaten dienen aan boord te zijn en kunnen worden opgevraagd. Bij gebreke aan een (geldig) verzekeringscertificaat kan er onder meer een verwijderingsbevel worden uitgevaardigd of kan het schip de toegang tot de Belgische havens worden ontzegd. Ook het opleggen van boetes behoort tot de sanctiemogelijkheden.

Het zal afwachten worden in hoeverre deze controles uitgevoerd en of de respectieve sancties effectief worden opgelegd. Deze wet biedt in ieder geval een bijkomend instrument om substandaard-rederijen aan te pakken en moet dus bijdragen aan de veiligheid van de Belgische havens in het algemeen.
